1. Acceptance of Terms

By accessing or utilizing the design subscription services offered by C'est Bon ("Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not access or use our services.

2. Subscription Model & Services

C'est Bon provides unlimited design request and revision services under a flat-rate monthly subscription model. Upon subscribing, you gain access to our active request queue, subject to the active plan selected. Work is delivered iteratively, addressing active design requests one at a time.

3. Design Requests & Management

All design requests are managed and submitted directly via Trello or other supported mediums agreed upon at onboarding (such as sharing Google Docs, wireframes, or custom Loom video briefings). You may add as many requests to your queue as you like, and they will be executed one by one in the order of priority defined by you.

4. Turnaround Times & Delivery

While we strive for exceptionally fast delivery (averaging under 24–48 hours for standard requests), turnaround times can vary based on request complexity, volume, and current queue activity. We make no strict guarantees of specific delivery hours, and deadlines discussed are estimates only.

5. Intellectual Property & Ownership

Upon full and final payment of your subscription fees, all original design works, source files, and final deliverables created by C'est Bon specifically for you shall belong entirely to you (the Client). We retain no ownership over final design outputs. However, you grant us a royalty-free, perpetual, worldwide license to showcase and display the completed works in our promotional portfolios, case studies, and marketing materials, unless explicitly opted-out in writing.

6. Client Responsibilities & Materials

You represent and warrant that any text, images, logos, trademarks, or other materials provided to us for inclusion in your designs do not infringe upon any third-party copyrights, patents, or trademarks. You are solely responsible for obtaining necessary permissions and licenses for any assets you supply.

7. Refund Policy

Due to the bespoke, creative, and high-quality nature of our custom design work, we offer a strict refund policy:

  • Refund requests must be submitted within the first seven (7) calendar days of starting your subscription service.
  • Absolutely no refunds will be issued for completed design work or projects already delivered.
  • No refunds will be granted after the first week (7 days) of service has elapsed under any circumstances.

8. Subscription Pauses and Cancellations

You have full flexibility to pause or cancel your C'est Bon subscription at any time. When paused, any remaining unused billing days in your current cycle will be preserved and can be resumed at a future date. Cancellations will stop future renewals, and your active access will expire at the end of your current paid billing period.

9. Refusal & Limitation of Service

We reserve the right to refuse service, cancel active subscriptions, or decline specific request tasks at our sole discretion. We do not support design work that is unlawful, offensive, discriminatory, or infringes on third-party intellectual property. Specifically, our design services do not cover: 3D modeling, animated graphics, extensive video editing, complex legal or medical document layout, extensive print publishing, or Adobe InDesign formats.

10. Limitation of Liability

In no event shall C'est Bon, its operators, or affiliates be liable for any direct, indirect, accidental, consequential, special, or exemplary damages arising out of the use or inability to use our services, including but not limited to loss of profits, goodwill, data, or other intangible losses, even if we have been advised of the possibility of such damages.

11. Governing Law

These Terms shall be governed by, and construed in accordance with, the laws of the Province of Alberta, Canada, without giving effect to any principles of conflicts of law. Any legal actions or proceedings arising under these Terms shall be brought exclusively in the courts located in Calgary, Alberta.
